Emissions Warranty Information

Usage:

3516C T2X
Caterpillar Inc., or any of its subsidiaries warrants new 3516C engines sold by it for use in locomotive applications to be designed, built and equipped so as to conform at the time of sale with applicable regulations under Section 213 of the Clean Air Act, and to be free from defects in materials and workmanship which cause such engines to fail to conform with those regulations for the applicable warranty period.

This emissions warranty is subject to the following:

Warranty Period

The warranty period on the new engine and related attachments supplied or installed by Caterpillar shall be for the first one-third (1/3) of the engine's useful life as defined in its EPA certificate of conformity, starting from the date the locomotive in which the engine is installed has a Caterpillar approved installation audit completed, defects corrected, and is delivered to the first user.

Applicability and Coverage

This warranty applies to and covers:

  • Engines powering locomotives in the U.S. and Canada.

  • Failures due to defects in materials or workmanship in Caterpillar Supplied Emissions-Related Components

  • Replacement Emissions-Related Components for the remainder of the warranty period

For purposes of this warranty, Caterpillar Supplied shall mean any part, component or system designed, manufactured, installed or supplied by Caterpillar to the Locomotive Manufacturer upon initial sale of the engine, including like-kind replacement parts.

For purposes of this warranty, Emissions-Related Component means:

  • Fuel Injection System, including camshaft, cam lifters/followers, and fuel lines

  • Fuel System Electronic Controls, including ECM, unit injectors, speed sensor, and timing position sensor

  • Turbocharger System, including turbine wheels and housings

  • Intake Manifold, including gasket and aftercooler

  • Closed Crankcase Ventilation System

  • Piston, ring, and liner

Caterpillar Responsibilities

If a defect in material or workmanship is found in a Caterpillar Supplied Emissions-Related Component during the warranty period, Caterpillar will, during normal working hours:

  • Provide new, remanufactured, or repaired parts or assembled components needed to correct the defect.

Note: Items replaced under this warranty become the property of Caterpillar.

  • Replace lubricating oil, filters, antifreeze and other service items made unusable by the defect

  • At a repair facility of the user, when required and with reasonable notice, provide a serviceman to assist and oversee the repair of the defect

  • Provide reasonable and customary labor necessary to correct the defect

Locomotive Manufacturer Responsibilities and Express Exclusions

The Locomotive Manufacturer is responsible for defects in materials and workmanship as to any Emissions-Related Component, system, or other part that is not Caterpillar Supplied. Warranty claims related to such components should be directed to the Locomotive Manufacturer. Components expressly excluded from this warranty under this section include:

  • Wiring and electrical systems

  • Ventilation Systems

  • Cooling Systems

User Responsibilities

The user is responsible for:

  • All proper maintenance, at the owners expense, of the Locomotive and Locomotive Engine, including replacement or service of all standard locomotive components and parts in general use prior to 1999, including: Repair, cleaning and replacement of fuel system injectors and other components due to use, wear and tear., All manufacturer recommended maintenance and fluid changes at scheduled intervals. and Use of proper fuel, oil, lubricants, coolant and filters.

  • Parts shipping charges in excess of those, which are usual and customary

  • Local taxes, if applicable

  • Costs to investigate complaints, unless the problem is caused by a defect in material or workmanship in a Caterpillar Supplied Emissions-Related Component

  • Giving timely notice of a warrantable failure and promptly making the product available for repair

  • Allowing Caterpillar access to all electronically stored data

Limitations

In addition to any other limitation stated herein, Caterpillar is not responsible for failures due to:

  • Any use or installation that Caterpillar judges improper

  • Attachments, systems, accessories, components or parts designed, manufactured, or installed by the Locomotive Manufacturer

  • Users delay in making the product available after being notified of a potential product problem

  • Abuse, neglect and/or improper repair, including the installation of parts or assembled components in contaminated systems

  • Unauthorized repair or adjustments, and unauthorized fuel setting changes

  • Damage to parts, fixtures, housings, attachments or accessory items that are not a part of the engine

NEITHER THE FOREGOING EXPRESS WARRANTY NOR ANY OTHER WARRANTY BY CATERPILLAR, EXPRESS OR IMPLIED, IS APPLICABLE TO ANY ITEMS CATERPILLAR SELLS WHICH IS WARRANTED DIRECTLY TO THE USER BY ITS MANUFACTURER. THIS WARRANTY IS EXPRESSLY IN LIEU OF ANY OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE. REMEDIES UNDER THIS WARRANTY ARE LIMITED TO THE PROVISION OF MATERIALS AND SERVICES, AS SPECIFIED HEREIN. CATERPILLAR IS NOT RESPONSIBLE FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES.
